At Texchem, we believe good business starts with clear expectations, responsible product use, and fair accountability. This policy explains the basis on which we supply products, the standards we apply in manufacturing, and the responsibilities of customers when selecting and using our products.
Product Quality and Manufacturing Standards
Texchem manufactures its products in accordance with the strict requirements of its ISO 9001-accredited quality management system.
We are committed to maintaining consistent manufacturing standards, batch control, traceability, and quality assurance processes in the production of our products.
While every reasonable care is taken in the manufacture, testing, and supply of our products, all products must still be used correctly and for their intended purpose.
Customer Responsibility for Product Selection and Use
It is the customer’s responsibility to ensure that the product ordered is the correct product for the intended application, surface, fabric, material, environment, equipment, and method of use.
Texchem cannot be held responsible for loss, damage, or unsatisfactory results arising from:
- incorrect product selection
- misuse or inappropriate use
- failure to follow instructions, label guidance, or good industry practice
- use of the product on unsuitable surfaces, materials, or items
- excessive dilution, under-dilution, or incorrect mixing with other chemicals or products
- abnormal storage conditions, contamination after delivery, or improper handling by the customer
Any advice, guidance, or recommendation given by Texchem is provided in good faith based on the information made available to us. Final suitability remains the customer’s responsibility.
Testing Before Full Application (This is an essential condition of use)
Customers must always test the product on a small, inconspicuous area before applying it to a wider area, full load, full surface, garment batch, linen batch, or production run.
Different materials, dyes, finishes, contaminants, water conditions, surfaces, and operating methods may affect the performance of a product. A successful small-area or small-batch test helps confirm compatibility and suitability before large-scale application.
Failure to carry out a proper test before full use is at the customer’s own risk.
Batch Samples and Traceability
Texchem retains a sample of every batch manufactured for quality control, traceability, and accountability purposes.
These retained samples allow us to:
- verify batch consistency
- investigate customer queries or complaints
- conduct back-testing where necessary
- compare supplied product against retained control samples
This process assists us in resolving product-related enquiries fairly and responsibly.
Defective Product Procedure
If a product is found, upon reasonable investigation and testing, to be defective due to manufacturing fault, Texchem may, at its election:
- replace the defective product, or
- refund the purchase price of the defective product
Any claim regarding an allegedly defective product must be reported promptly and supported with reasonable details, including batch information where available.
Texchem reserves the right to inspect, test, or request return of the product in question before confirming any remedy.
Limitation of Liability
To the fullest extent permitted by law, Texchem shall not be liable for indirect, consequential, special, incidental, or large-scale damage arising from the use of its products.
Without limiting the above, Texchem accepts no responsibility for:
- damage to full production runs, full loads, garments, linen, fabrics, surfaces, equipment, or stock where the customer failed to first test the product on a small area or limited sample
- damage caused by the customer ordering the wrong product
- damage caused by misuse, over-application, under-dilution, incorrect dilution, mixing, or unsuitable application
- loss of profit, business interruption, reputational loss, or third-party claims arising from product use
Where a product is proven to be defective, Texchem’s responsibility is limited to replacement of the product or refund of its purchase price, unless applicable law requires otherwise.
No Responsibility for Inappropriate or Incorrect Use
Texchem supplies products for specific intended uses. We cannot take responsibility where a product is:
- used outside its intended purpose
- applied contrary to written instructions or normal practice
- used without first testing suitability
- selected by the customer for the wrong application
Customers are expected to exercise proper care and professional judgement in the storage, handling, dilution, testing, and use of all products.
Returns and Claims
No product may be returned without prior communication with Texchem.
Claims relating to alleged defects, shortages, or supply errors should be raised as soon as reasonably possible after delivery or discovery.
Texchem may request supporting information, photographs, samples, batch numbers, proof of purchase, usage details, or access to the affected product or area as part of its investigation.
Storage and Handling
Products must be stored, handled, and used in accordance with any applicable label instructions, safety guidance, technical information, and good practice.
Texchem shall not be responsible for product deterioration, instability, or performance issues arising after delivery due to poor storage, contamination, tampering, exposure to heat, cold, sunlight, moisture, or other unsuitable conditions outside our control.
General
This policy forms part of the basis on which Texchem supplies products to its customers.
Nothing in this policy is intended to exclude any right or obligation that may not lawfully be excluded under applicable law.
Texchem may update this policy from time to time. The latest version issued by Texchem will apply from its effective date.
